GENERAL TERMS AND CONDITIONS OF SALE

Preamble :

These General Terms and Conditions of Sale (GTC) apply to all sales concluded by Galerie Lahumière (hereinafter referred to as "the Gallery") with its clients wishing to purchase works offered for sale on its website www.lahumiere.com. Any order implies unreserved acceptance of these GTC.

Guarantee :

Unless otherwise stated, all works are in excellent condition. Works on paper are sold unframed unless otherwise specified. All works presented are guaranteed authentic and delivered with an invoice serving as a certificate of authenticity. Photographs and descriptions of works published on www.lahumiere.com, despite every care taken in their preparation, may contain errors or omissions and are not contractually binding. It should be noted that there are always some differences between the colors of the artwork on screen and the actual colors of the artwork. Do not hesitate to ask us for further details. Upon request, we will provide additional photographs. Under no circumstances shall Galerie Lahumière be held liable for any errors or omissions in the wording of a descriptive notice or in a photograph of a work published on the website www.lahumiere.com. Only the issued invoice is legally binding.

Price :

All prices are NET in EUROS (EUR). They are subject to change without notice. Payments are accepted in EUR only.

Order :

The unavailability of one or more works does not constitute grounds for liability on the part of Galerie Lahumière. All orders are final and binding. Any modifications or cancellations requested by the client must be submitted by email before the artworks are shipped. All orders are subject to prior agreement with our general terms and conditions of sale.

Payment methods and terms:

Payment is due in full before shipment of the order and can be made by: Visa or Mastercard credit card on the website www.lahumiere.com, check (only for buyers with a bank account in France), or bank transfer (bank fees are the responsibility of the buyer). Payments are accepted in EUROS only.

Ownership of the works:

The artworks remain the property of Galerie Lahumière until full payment of the agreed price, in accordance with the provisions of Articles 2367 et seq. of the French Civil Code relating to retention of title. In the event of non-payment, the Gallery reserves the right to repossess the artworks.

Transport, insurance and customs:

Whether shipped in a tube, flat-packed, or otherwise, the shipping cost will be communicated to you directly during the online checkout process or quoted by email. Shipping is handled by us, and the cost of insurance is included in the shipping fees up to €5,000. In the event of loss or damage, it is the customer's responsibility to file all necessary claims with the carrier within the legal timeframe (from 48 hours to 7 business days depending on the destination; see the carrier's terms and conditions, which are the only legally binding terms). The transfer of risk occurs upon delivery of the package to the carrier (Incoterm CIP). We arrange delivery via the carrier of our choice unless you specify otherwise. In that case, the Incoterm EXW will apply. CUSTOMS: If applicable, the payment of customs duties and clearance fees upon arrival of the package in the destination country is the customer's responsibility. 

Complaints:

In the event of a delivery error, an undisclosed visible defect, or a work of art not conforming to its certificate of authenticity, claims must be made by email within 8 days (14 days for customers in France and the EEC) of receiving the package. If a return is requested, the shipping costs will be borne by the customer.

Right of withdrawal:

For sales made physically in the gallery, customers do not have the right of withdrawal unless otherwise stipulated. Any request to exercise the right of withdrawal for sales made on the website www.lahumiere.com and shipped by the gallery must be made by email within 8 days (14 days for customers in France and the EEC) of receiving the package. (See: Law No. 2014-344 of March 17, 2014). Refund: the purchase price less return shipping costs, additional packaging and insurance fees, and any customs duties will be credited to the buyer's account within 7 days of receipt of the package.

 Return of goods:

No returns will be accepted without prior agreement. After agreement (justified claim or exercise of the right of withdrawal), we will ask you to repackage the artworks, taking all necessary precautions for rare and collectible pieces, in their original packaging. Return shipping instructions will then be provided. In the event of loss or damage to the original packaging, the customer must provide equivalent packaging at their own risk. However, we can provide replacement packaging at the customer's expense to ensure the safe return of the artworks. Artworks that are damaged, soiled, or otherwise compromised due to customer negligence will not be accepted. We reserve the right to have the package opened by a bailiff at the customer's expense for the purpose of documenting the damage in the event of obvious negligence in the packaging of the artworks.

Applicable law and jurisdiction:

All our sales are governed by French law, regardless of the customer's country of residence, the place where the order was placed, or the delivery address. Should any provision of these Terms and Conditions be deemed invalid, void, or unenforceable for any reason, that provision shall be considered severable and shall not affect the validity and scope of the remaining provisions. In the event of a dispute, the customer should first contact Galerie Lahumière to seek an amicable solution. Any dispute relating to the interpretation of these Terms and Conditions shall, failing an amicable agreement, fall under the exclusive jurisdiction of the Commercial Court of Paris. Galerie Lahumière's liability shall, in any event, be limited to the amount of the order. Please do not hesitate to contact us if you have any questions.

 Privacy and data protection:

Galerie Lahumière is committed to respecting the confidentiality of personal information provided by the client and to using it solely within the framework of the business relationship. It complies with the provisions of the General Data Protection Regulation (GDPR) and the French Data Protection Act, and implements appropriate security measures to protect personal data against any intrusion, loss, or alteration.

 Modifications:

Galerie Lahumière reserves the right, at its sole discretion, to modify this Charter at any time, in whole or in part.
